Formation of contract and cancellation
A contract will only be formed between Memories2Disc Limited and you once we have given to you written notice (by letter or by e-mail) of our acceptance of your offer and receipt of your payment. By sending us the order form you authorise Memories2Disc Ltd to start work on your order and your cancellation rights will end as soon as Memories2Disc Ltd starts work on your order (where you wish us to provide services).
Sending and Returning Your Source Media
You are strongly advised to use a delivery service, requiring a “signature on delivery” when sending your source media and payment to Memories2Disc Limited. Depending on your instructions, Memories2Disc Limited will use Royal Mail Recorded Delivery, Royal Mail Special Delivery, Royal Mail Parcel Force (or an equivalent delivery service) providing signature on delivery, web-based tracking facilities and insurance. Any disputes regarding loss or damage of your goods whilst in transit should be taken up direct with the delivering company.
Safety of your Source Material
In the unlikely event of Memories2Disc Limited being the cause of damage to or loss of any of your materials, your media will be replaced with a new blank replacement (video tape, camcorder tape or roll of film) only and the return delivery costs to you will be paid. This does not apply to tapes that have arrived in a damaged or unusable state or tapes that are damaged during playback due to defects or simply being very old. In this case, the customer must cover all return postage and packaging costs before their materials are returned.
Turnaround Time
We aim to complete and dispatch your order within 10 working days from receipt of cleared payment from you; however at busy times please allow upto 28 days. Orders for 10 or more tapes or additional copies will be subject to current workload and seasonal trends. Please enquire at time of ordering if you have any particular deadline for completion of the work.
Privacy and Confidentiality Policy
We promise to respect the privacy and confidentiality of your identity and audio visual material. We will not supply your contact information to any third party companies unless you specifically ask us to. Where we are required to by law, we will release information or material submitted to Memories2Disc Limited to the Courts or to the Police.
From time to time we would like to email you with special offers and other related news. Your email address will only be held electronically if you give us your consent to do so. However, if you decide at a later date you would like your email address to be removed, simply reply to any message sent by us and placing the word “REMOVE” in the subject line.
Text, Menus and Chapters
We will choose the most appropriate design of menu to accommodate the length of film and number of chapter points required. The name of each chapter point required must be provided to us in writing (preferably clearly typed failing which clearly written in block capitals). We cannot accept responsibility for mis-interpretations of handwriting or mis-spellings and if we cannot read the writing, we will simply number the chapter. Where text is to be included in the order or the packaging, such as chapter names and titles etc, Memories2Disc cannot be held responsible for spelling / grammar errors when the text is not supplied in a clear typed format. We will attempt to read handwritten text, but if the words are spelt incorrectly, the customer will be responsible for the cost involved with re-doing the work.
DVD Format
As standard, our DVDs are region-free and play in PAL. We use Verbatim DVD-R Discs.
If you wish your footage to be transferred to DVD+R instead, please advise us at time of ordering.
We can produce NTSC DVD, however we do make an additional charge for this.
Payment
All prices quoted are in UK Pounds (Sterling) and are inclusive of VAT.
Payment must be sent with your order and we will not undertake work until payment has been received.
We accept payment by Cheque, Bankers Draft, Postal Order, Debit / Credit Card & PayPal. Cheques, Bankers Draft and Postal Orders must be made out in favour of Memories2Disc Limited and Debit / Credit Card Payments and PayPal payments can be made via our website www.memories2disc.co.uk.
Our Rights to update our Website (Information, Prices and Services)
It is important to us to be able to alter our information, pricing and services to meet customer needs and to remain competitive whilst providing a professional service. We therefore reserve the right to modify our website, services and pricing at any time. However, we will honour your order should it be placed up to 2 weeks after the change. Memories2Disc will apply either the price at the time of order or our new prices (which is in your favour).
Content of Film / Disclaimer
By submitting an order to Memories2Disc Limited, I represent and warrant that:
I am not infringing the intellectual property of any other person contained in the material submitted and I have the right to permit Memories2Disc Limited to perform their services I have requested on videotape / camcorder tape / photos / slides / digital media card or storage device I have submitted.
The content of the material and the provision of the processing service on my behalf is not for any illegal, obscene, offensive or immoral purpose.
Neither the Content nor the provision of the processing and / or hosting of the Content will injure, infringe, or violate any patent, copyright, trade secret, trademark or intellectual property right of any third party (including but not limited to any performance licence rights, mechanical licence rights or synchronization licence rights) or violate any obscenity law or other applicable law, rule or regulation in any jurisdiction which the Content may be viewed or retrieved.
Memories2Disc have the right to reject any work I submit to them for copying and converting which they feel is contrary to the above. I agree to pay Memories2Disc Limited postage and packaging costs to return my rejected material to me.
I also agree that Memories2Disc, and its employees shall not be otherwise liable to me for any loss or damage of any kind or nature (including but not limited to loss of enjoyment, distress, discomfort or inconvenience), whether direct, incidental, consequential, or otherwise. In the event of loss of or damage to the materials caused by Memories2Disc Limited then I agree and acknowledge that Memories2Disc Limited shall be liable to compensate me to the value of the sum of money actually paid by me. This limit of liability will not apply in the event of personal injury suffered by me or in the event of fraud or manifest dishonesty on the part of Memories2Disc Limited.
I will indemnify and hold Memories2Disc harmless in respect to any claim of violation of such laws. I declare the materials submitted were either created under my copyright or that I have permission of the copyright owner to convert / transfer / duplicate them and that I consent (including on behalf of any third party) to processing of any images of recognisable individuals.
